The Federal High Court sitting in Awka has sacked Hon Ifeanyi Chudy Momah from the green chamber of the National Assembly.

Hon Chudy Momah is the Peoples Democratic Party (PDP) flag bearer in the 2023 House of Representatives for Ihiala federal constituency.

In a judgment delivered on Friday, 20th January 2023 in Suit No. FHC/AWK/CS/134/2022: Chief Maurice Ezebunanwa v. Hon. Ifeanyi Chudy Momah & Ors, the Court presided over by Hon. Justice H. A. Nganjiwa held that Hon. Momah ought to have vacated his position as Member representing Ihiala Federal Constituency in the House of Representatives since May 2022 when he resigned from the All Progressives Grand Alliance (APGA).

Hon Justice Nganjiwa averred that the resignation of the lawmaker has become imperative because APGA being the political party that sponsored his election to the House of Representatives in 2019 before he later joined PDP.

The Court, while declaring the said seat as vacant, issued an injunction precluding Hon. Momah from continuing to parade himself as Member representing Ihiala Federal Constituency in the House of Representatives.

Hon Justice Nganjiwa further ordered Hon. Momah to refund all salaries and other benefits he received since May 2022 when he ought to have vacated the said seat.

The Court also ordered INEC to conduct a bye-election to fill the vacancy.
