ABUJA — Dr. Austin Orette, who is lthe African Democratic Congress (ADC) senatorial candidate for Delta South, has urged his supporters to remain calm and steadfast as he pursues legal action challenging his exclusion from the Independent National Electoral Commission (INEC) list of candidates ahead of the 2027 general elections.

Orette has approached the Federal High Court in Abuja, seeking judicial intervention over the omission of his name from INEC’s final list of candidates for the Delta South Senatorial District election.

The legal action follows the omission of his name from the list published on September 12, 2026, despite the fact that he emerged victorious in the ADC senatorial primary conducted on May 22, 2026.

In the suit filed through his counsel, James Olotu, Orette named INEC as the first defendant and the ADC as the second defendant.

He is seeking a declaration that, having emerged as the winner of the party’s primary election, he is entitled to be recognised as the ADC candidate for the Delta South Senatorial District in the 2027 elections.

The plaintiff is also asking the court to determine whether INEC acted lawfully in excluding his name from the final list after receiving a letter from the ADC on July 14, 2026, communicating his nomination.

Orette is further seeking a declaration that the publication of the final list, insofar as it excluded his name, was unlawful, null and void.

The suit invokes provisions of the 1999 Constitution, as amended, the Electoral Act 2026, the Federal High Court (Civil Procedure) Rules 2019 and the Federal High Court (Pre-Election) Practice Directions 2026.

At the heart of the dispute is whether Orette’s emergence from the party primary and the submission of his name to INEC fulfilled the applicable legal requirements for recognition as the party’s senatorial candidate.

The outcome of the case will determine the legal status of his claim to the ADC ticket and whether INEC should recognise him as the party’s candidate for the Delta South senatorial contest.

Despite the legal challenge, Orette is urging his supporters not to panic over his omission from the INEC list, but to remain calm and focused while the judicial process takes its course.

His decision to seek legal redress has not brought his political activities to a halt, as he continues his campaign ahead of the 2027 general elections as he’s confident that that INEC would eventually publish his name as the candidate of the party as it is obvious that the errors came from INEC

The development adds a legal dimension to the contest for the ADC senatorial ticket in Delta South, with the court expected to determine the issues raised in the suit.

Orette’s supporters are being urged to remain patient as the legal process unfolds, while the dispute over the party’s senatorial candidacy awaits judicial determination.
