Wants Court To Restrain Them, Say Their Tenure Has Expired

Some notable critical stakeholders of Itsekiri National Youths Council, INYC, Comrade David Iwere, Comrade Collins Timeyin Edema, immediate past President of National Association of Itsekiiri Graduates, NAIG, Comrade Tuoyo Ofuyekpone, Comrade Omatseye Tuasor and Comrade Bawo Eyeoyibo, have on behalf of themselves and other members of the INYC excluding the defendants dragged the ITSEKIRI NATIONAL YOUTHS COUNCIL, INYC, Comrade Oritseweyinmi Agbateyeniro who currently still parades himself as President of the body and Comrade Appearance Afejuku, as well as Comrade Comrade Ernest Ekpoto to court to stop parading themselves as executive of the INYC as their tenure have since expired.

In a suit no W259/2020 filed by the claimants, Comrade David Iwere, Comrade Collins Timeyin Edema, Comrade Tuoyo Ofuyekpone, Comrade Omatseye Tuasor and one other brought forward to the High Court of Justice Delta State in the Warri Judicial Division versus Agbateniro, Afejuku, Eyeoyibo for themselves and the said outgone executive led by Comrade Agbateyiniro as defendants, the claimants are saying in their summons that the purported inauguration and continued stay in office as leaders of INYC and exercise such powers without the approval of the registered Trustees of the INYC which established it is illegal, null and void.

The claimants, Comrade Iwere, Comrade Edema, Comrade Ofoyekpone and 2 others are however seeking a restraining order of injunction to stop Comrade Agbateyiniro, 2nd and 3rd defendants from parading themselves or holding the status or addressed as executive of INYC.

The claimants are also asking for the court to set aside the purported inauguration of INYC executive by their servants or privies.

The claimants sought for an order of court directing the Board of Trustees of the INYC which established the outgone executive to setup a committee to midwife the participatory processes to establish new executive for the INYC in accordance with the conventions and protocols of INYC known to the parties by which the defendants emerged as executive members initially which tenure have since expired.

According to the case filed in court in the Delta State High Court Warri Division, Friday, 4th December, 2020, for the claimants for themselves and other members of the INYC excluding the defendants through their attorney, Clement Omotoye Esq., “the summons also prayed for an order of court mandating the defendants Comrade Agbateyiniro, Comrade Afejuku and co to immediately present themselves to the Board of Trustees of the Itsekiri National Youths Council, INYC, to present an account of their tenure which is known to all parties to have expired according to the conventions and protocols establishing the INYC,” they posited.
