Moves To Secure Release Of Suspect, John Iyu Fingered In Adjogbe’s Death Fails, As Court Rejects Application

The Federal High Court has refused an application for enforcement of the fundamental human rights of Chief John Iyu, a suspect in the ongoing murder case of late Sylvester Adjogbe.

The suspect, Chief John Iyu through an application brought against the Nigerian Police Force, Inspector General of Police, Commissioner of Police and the Police Service Commission as first, second, third and fourth respondents respectively in suit number FHC/ABJ/CS/1102/2020, prayed the honourable court for the following reliefs:

1. An order to enforce, and or secure the enforcement of the fundamental rights of the applicant in terms of the reliefs set out in paragraph 2 of the statement accompanying this application namely:
2. A declaration that the arrest and continued detention of the Applicant since August 4, 2020 is unlawful, unconstitutional and illegal.

Presiding Judge of Federal High Court 9 Abuja, Justice Taiwo Taiwo in a well considered judgement dated 18 February 2021, rejected the prayers of the applicant and ruled in favour of the respondents.

The late Sylvester Adjogbe was gruesomely murdered in his father’s compound during the crisis that rocked Evwreni Community in Ughelli North Local Government Area of Delta State, in 2020.

Meanwhile in a further development, the failure of the Ovie of Evwreni Kingdom, HRM Oghenekevwe Kumane, to appear at the Federal High Court, Warri, on Wednesday, stalled the arraignment of suspects arrested over the murder of the late Sylvester Adjogbe.
