Law Says If Labour Party Withdraws From Petition Against Tinubu Peter Obi Can Go On With It – Ononuju

It is common knowledge that Peter Obi and his party, Labour Party filed a petition in court challenging the victory of APC’s Bola Tinubu in the presidential election.

However, amid the leadership tussle in the party, there are concerns that some members of the party are plotting to withdraw the petition filed against Tinubu.

However, speaking in an interview with News Central TV, Peter Obi’s special adviser on public affairs, Dr Katch Ononuju disclosed that according to the law, the petition that his principal and the Labour Party filed in court cannot be withdrawn by the party without Obi’s consent.

He said before a petition can be withdrawn, all the parties who filed the petition must agree to the action.

About 12:45 minutes into a video shared on YouTube, Ononuju said “I do not think the internal affairs of the party are things we can wish away but I can tell you it will be wrong for anybody to think that the current crisis is new. Parties in incumbent positions always instrument acrobatics like this when they are challenged at tribunals every time after a general election.

“Those are the reasons that informed Peter Obi my principal putting his name to the petition and as the law says, if all the parties to the petition do not agree to withdraw the petition the petition shall continue at the tribunal. It was as Mr Peter Obi described his experience at the Tribunal during the Anambra State governorship where Mr Onyechi, SAN, advised him ‘do not remove your name, put your name so that should the party get compromised on its way, you will continue to remain in court’ and with that experience, Peter Obi put his name.”
